Lawful to you is game from the sea and its food as provision for you and the travelers, but forbidden to you is game from the land as long as you are in the state of ihram. And fear Allah to whom you will be gathered.

أحل لكم صيد البحر ("Lawful for you is the game of the sea.")
The exposition of His exalted word: أحل لكم صيد البحر ("Lawful for you is the game of the sea"). The Exalted, whose praise be mentioned, says: "Lawful for you," O believers, "is the game of the sea" — and that is what is caught fresh. As:
9876 - Yaʿqūb related to me, saying: Hushaym related to us, saying: ʿUmar ibn Abī Salama informed us, on the authority of his father, on the authority of Abū Hurayra, who said: ʿUmar ibn al-Khaṭṭāb said concerning His word: أحل لكم صيد البحر ("Lawful for you is the game of the sea"), he said: its game is what is caught of it.
9877 - Ibn Ḥumayd related to me, saying: Jarīr related to us, on the authority of Mughīra, on the authority of Simāk, who said: it was related to me, on the authority of Ibn ʿAbbās, who said: Abū Bakr delivered a sermon to the people and said: Lawful for you is the game of the sea. He said: its game is what is seized.
9878 - Yaʿqūb related to me, saying: Hushaym related to us, saying: Ḥuṣayn informed us, on the authority of Saʿīd ibn Jubayr, on the authority of Ibn ʿAbbās, concerning His word: أحل لكم صيد البحر he said: its game is what is caught of it.
9879 - Sulaymān ibn ʿUmar ibn Khālid al-Barqī related to us, saying: Muḥammad ibn Salama al-Ḥarrānī related to us, on the authority of Khaṣīf, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, concerning His word: أحل لكم صيد البحر he said: its game is the fresh.
* - Ibn Ḥumayd related to us, saying: Yaḥyā ibn Wāḍiḥ related to us, saying: al-Hudhayl ibn Bilāl related to us, saying: ʿAbdallāh ibn ʿUbayd ibn ʿUmayr related to us, on the authority of Ibn ʿAbbās, concerning His word: أحل لكم صيد البحر he said: its game is what is caught.
* - Muḥammad ibn Saʿd related to me, saying: my father related to me, saying: my uncle related to me, saying: my father related to me, on the authority of his father, on the authority of Ibn ʿAbbās: أحل لك صيد البحر he said: the fresh.
* - Ibn Wakīʿ related to us, saying: al-Ḥasan ibn ʿIkrima ibn al-Jaʿfī — or al-Ḥusayn, Abū Jaʿfar is in doubt — related to us, on the authority of al-Ḥakam ibn Abān, on the authority of ʿIkrima, who said: Ibn ʿAbbās used to say: the game of the sea is what one catches of it.

9881 - Ibn Ḥumayd related to us, saying: Ḥakkām related to us, on the authority of ʿAnbasa, on the authority of al-Ḥajjāj, on the authority of al-ʿAlāʾ ibn Badr, on the authority of Abū Salama, who said: the game of the sea is what is caught.
* - Ibn Wakīʿ related to us, saying: my father related to us, on the authority of Sufyān, on the authority of Abū Ḥaṣīn, on the authority of Saʿīd ibn Jubayr: أحل لكم صيد البحر he said: the fresh.

* - Ibn Bashshār related to us, saying: ʿAbd al-Raḥmān ibn Mahdī related to us, saying: Sufyān related to us, on the authority of Abū Ḥaṣīn, on the authority of Saʿīd ibn Jubayr: أحل لكم صيد البحر he said: the fresh fish.
9882 - Muḥammad ibn al-Ḥusayn related to us, saying: Aḥmad ibn al-Mufaḍḍal related to us, saying: Asbāṭ related to us, on the authority of al-Suddī: أحل لكم صيد البحر as for the game of the sea: that is the fresh fish, that is the fishes.
9883 - Al-Qāsim related to us, saying: al-Ḥusayn related to us, saying: Abū Sufyān related to us, on the authority of Maʿmar, on the authority of al-Zuhrī, on the authority of Saʿīd ibn al-Musayyab, who said: its game is what you have caught fresh. Maʿmar said: and Qatāda said: its game is what you have caught.
9884 - Muḥammad ibn ʿAmr related to me, saying: Abū ʿĀṣim related to us, saying: ʿĪsā related to us, on the authority of Ibn Abī Najīḥ, on the authority of Mujāhid, concerning the word of Allah: أحل لك صيد البحر he said: its fishes.
9885 - Ibn al-Barqī related to us, saying: ʿUmar ibn Abī Salama related to us, saying: Saʿīd was asked about the game of the sea and said: Makḥūl said: Zayd ibn Thābit said: its game is what you have caught.
9886 - Ibn Ḥumayd related to us, saying: Jarīr related to us, on the authority of Layth, on the authority of Mujāhid, concerning His word: أحل لك صيد البحر وطعامه متاعا لك وللسيارة he said: the one in the state of consecration (muḥrim) and the non-consecrated may hunt from the sea, and he may eat of his game.
9887 - ʿAmr ibn ʿAbd al-Ḥamīd related to us, saying: Ibn ʿUyayna related to us, on the authority of ʿAmr, on the authority of ʿIkrima, who said: Abū Bakr said: the food of the sea is everything that is in it. And Jābir ibn ʿAbdallāh said: whatever is laid bare of it, eat of it. And he said: everything that is in it, that is to say: all that is caught.
9888 - Saʿīd ibn al-Rabīʿ related to us, saying: Sufyān related to us, on the authority of ʿAmr, who heard ʿIkrima say: Abū Bakr said: وطعامه متاعا لك وللسيارة he said: that is everything that is in it. And by "the sea" in this place is meant: all rivers; the Arabs call rivers "seas," as the Exalted, whose praise be mentioned, said: ظهر الفساد في البر والبحر ("Corruption has appeared on land and in the sea"). The exposition of the words is thus: Lawful for you, O believers, is the fresh fish of the rivers that you have caught in the state of your being unrestricted and your consecration, and what you have not caught of its food which the sea has killed and then cast out upon its shore.
وطعامه ("and its food")
The people of exposition differed concerning the meaning of His word: وطعامه ("and its food"). Some said: by it is meant: what it casts up dead upon its shore, in accordance with what we have said about it. Mention of who said that:
9889 - Ibn Ḥumayd related to us, saying: Jarīr related to us, on the authority of Mughīra, on the authority of Simāk, who said: it was related to me, on the authority of Ibn ʿAbbās, who said: Abū Bakr delivered a sermon to the people and said: Lawful for you is the game of the sea and its food as an enjoyment for you; and its food is what it casts out.
9890 - Yaʿqūb related to me, saying: Hushaym related to us, saying: ʿUmar ibn Abī Salama informed us, on the authority of his father, on the authority of Abū Hurayra, who said: I was in Bahrain, and they asked me about what the sea casts up; I gave them the fatwa that they might eat it. When I came to ʿUmar ibn al-Khaṭṭāb — may Allah be pleased with him — I mentioned that to him, and he said to me: what fatwa did you give them? I said: I gave them the fatwa that they may eat it. He said: had you given them a different fatwa, I would have chastised you with the whip. Then he said: Allah, the Exalted, has said in His Book: أحل لكم صيد البحر وطعامه متاعا لكم so its game is what is caught of it, and its food is what it casts out.
9891 - Yaʿqūb related to me, saying: Hushaym related to us, saying: Ḥuṣayn informed us, on the authority of Saʿīd ibn Jubayr, on the authority of Ibn ʿAbbās: أحل لكم صيد البحر وطعامه متاعا لكم he said: its food is what it casts out.
* - Yaʿqūb related to me, saying: Ibn ʿUlayya related to us, on the authority of Sulaymān al-Taymī, on the authority of Abū Mijlaz, on the authority of Ibn ʿAbbās, concerning His word: أحل لكم صيد البحر وطعامه he said: its food is what it casts out.
* - Ibn Wakīʿ related to us, saying: Abū Khālid al-Aḥmar related to us, on the authority of Sulaymān al-Taymī, on the authority of Abū Mijlaz, on the authority of Ibn ʿAbbās, the like of it.
9892 - Ibn Wakīʿ related to us, saying: Ḥusayn ibn ʿAlī related to us, on the authority of Zāʾida, on the authority of Simāk, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, who said: its food is everything that the sea washes ashore.
9893 - Ibn Wakīʿ related to us, saying: al-Ḥasan ibn ʿAlī — or al-Ḥusayn ibn ʿAlī al-Jaʿfī, Abū Jaʿfar is in doubt — related to us, on the authority of al-Ḥakam ibn Abān, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, who said: its food is what it spits out of its dead.

9894 - Saʿīd ibn al-Rabīʿ related to us, saying: Sufyān related to us, on the authority of ʿAmr, who heard ʿIkrima say: Abū Bakr — may Allah be pleased with him — said: وطعامه متاعا لكم he said: its food is everything that is in it.
9895 - Muḥammad ibn al-Muthannā related to me, saying: al-Ḍaḥḥāk ibn Makhlad related to me, on the authority of Ibn Jurayj, who said: ʿAmr ibn Dīnār informed me, on the authority of ʿIkrima, the client of Ibn ʿAbbās, who said: Abū Bakr said: وطعامه متاعا لكم he said: its food is its dead. ʿAmr said: and he heard Abū al-Shaʿthāʾ say: I always supposed that its food was nothing but its salted (fish).
* - Muḥammad ibn al-Muthannā related to us, saying: al-Ḍaḥḥāk ibn Makhlad related to me, on the authority of Ibn Jurayj, who said: Abū Bakr ibn Ḥafṣ ibn ʿUmar ibn Saʿd informed me, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, concerning His word: وطعامه متاعا لكم he said: its food is its dead.
9896 - Ḥumayd ibn Masʿada related to us, saying: Yazīd ibn Zurayʿ related to us, on the authority of ʿUthmān, on the authority of ʿIkrima: وطعامه متاعا لكم he said: its food is what it casts out.
9897 - Ibn ʿAbd al-Aʿlā related to us, saying: Maʿmar ibn Sulaymān related to us, saying: I heard ʿUbaydallāh, on the authority of Nāfiʿ, who said: ʿAbd al-Raḥmān came to ʿAbdallāh and said: the sea has washed ashore many fish? He forbade him to eat them and then said: O Nāfiʿ, bring the muṣḥaf! I brought it to him, and he read this verse: أحل لكم صيد البحر وطعامه متاعا لكم He said: I said: its food is what it washed ashore. He said: then go after him and command him to eat it.
* - Ibn Bashshār related to us, saying: ʿAbd al-Wahhāb related to us, saying: Ayyūb related to us, on the authority of Nāfiʿ, that ʿAbd al-Raḥmān ibn Abī Hurayra asked Ibn ʿUmar and said: the sea has cast out many dead fish, may we eat them? He said: do not eat them! When ʿAbdallāh returned to his family, he took the muṣḥaf and read Sūrat al-Māʾida, until he came to this verse: وطعامه متاعا لكم وللسيارة He said: go, tell him that he may eat it, for it is its food.
* - Yaʿqūb related to me, saying: Ibn ʿUlayya related to us, saying: Ayyūb informed us, on the authority of Nāfiʿ, on the authority of Ibn ʿUmar, the like of it.
* - Al-Muthannā related to me, saying: al-Ḍaḥḥāk ibn Makhlad related to us, on the authority of Ibn Jurayj, who said: ʿAmr ibn Dīnār informed me, on the authority of ʿIkrima, the client of Ibn ʿAbbās, who said: Abū Bakr — may Allah be pleased with him — said: وطعامه متاعا لكم he said: its dead. ʿAmr said: I heard Abū al-Shaʿthāʾ say: I always supposed that its food was nothing but its salted (fish).
* - Muḥammad ibn al-Muthannā related to us, saying: al-Ḍaḥḥāk ibn Makhlad related to us, on the authority of Ibn Jurayj, who said: Nāfiʿ informed us that ʿAbd al-Raḥmān ibn Abī Hurayra asked Ibn ʿUmar about many fish that the sea washed ashore, whether they were dead? He said: yes! And he forbade him them. Then he entered the house, asked for the muṣḥaf and read that verse: أحل لكم صيد البحر وطعامه متاعا لكم He said: its food is everything that is taken out of it; eat it, there is nothing wrong with it, and everything that is in it may be eaten dead, or on its shore.
9898 - Al-Qāsim related to us, saying: al-Ḥusayn related to us, saying: Abū Sufyān related to us, on the authority of Maʿmar, Qatāda said: its food is what it casts out of it.
9899 - Ibn Wakīʿ related to us, saying: Abū Khālid related to us, on the authority of Layth, on the authority of Shahr, on the authority of Abū Ayyūb, who said: what the sea spits out, that is its food, even if it is dead.
9900 - Hannād related to us, saying: Abū al-Aḥwaṣ related to us, on the authority of Layth, on the authority of Shahr, who said: Abū Ayyūb was asked about the word of Allah, the Exalted: أحل لكم صيد البحر وطعامه متاعا he said: it is what the sea spits out.
And others said: by His word وطعامه is meant the salted fish. Then the exposition of the words according to their exposition would be: Lawful for you is the fish of the sea and its salted (fish) in every state, in your being unrestricted and your consecration. Mention of who said that:

* - Al-Muthannā related to me, saying: ʿAbdallāh ibn Ṣāliḥ related to us, saying: Muʿāwiya ibn Ṣāliḥ related to me, on the authority of ʿAlī ibn Abī Ṭalḥa, on the authority of Ibn ʿAbbās: وطعامه متاعا لكم by its food He means: its salted (fish) and what the sea casts out of its salted (fish).
* - Muḥammad ibn Saʿd related to me, saying: my father related to me, saying: my uncle related to me, saying: my father related to me, on the authority of his father, on the authority of Ibn ʿAbbās: وطعامه متاعا لك and it is the salted (fish).
9902 - Abū Kurayb related to us, saying: Ibn Yamān related to us, on the authority of Sufyān, on the authority of Mujammiʿ al-Taymī, on the authority of ʿIkrima, concerning His word: متاعا لكم he said: the salted (fish).
9903 - Abū Kurayb related to us, saying: Ibn Yamān related to us, on the authority of Sufyān, on the authority of Sālim al-Afṭas and Abū Ḥaṣīn, on the authority of Saʿīd ibn Jubayr, who said: the salted (fish).
9904 - Abū Kurayb related to us, saying: Ibn Yamān related to us, on the authority of Sufyān, on the authority of Manṣūr, on the authority of Ibrāhīm: وطعامه متاعا لكم he said: the salted (fish) and what it casts out.
9905 - Ibn Ḥumayd related to us, saying: Ḥakkām related to us, on the authority of ʿAnbasa, on the authority of Sālim, on the authority of Saʿīd ibn Jubayr, concerning His word: أحل لكم صيد البحر وطعامه متاعا لكم he said: the man comes to the people of the sea and says: "give me to eat." If he says: "fresh," they cast their net and catch for him; and if he says: "give me of your food," they give him of their salted fish.
* - Ibn Wakīʿ related to us, saying: Ibn Fuḍayl related to us, on the authority of ʿAṭāʾ, on the authority of Saʿīd: أحل لكم صيد البحر وطعامه he said: the cast-out, the salted fish.
* - Ibn Wakīʿ related to us, saying: my father related to us, on the authority of Sufyān, on the authority of Abū Ḥaṣīn, on the authority of Saʿīd ibn Jubayr: وطعامه he said: the salted (fish).
* - Ibn Wakīʿ related to us, saying: my father related to us, on the authority of Sufyān, on the authority of Manṣūr, on the authority of Ibrāhīm: وطعامه he said: it is the salted of it. Then he said: what it casts out.
9906 - Ibn Muʿādh related to us, saying: Jāmiʿ ibn Ḥammād related to us, saying: Yazīd ibn Zurayʿ related to us, saying: Saʿīd related to us, on the authority of Qatāda: وطعامه he said: the salted fish.
* - Hannād related to us, saying: Ibn Abī Zāʾida related to us, saying: al-Thawrī informed me, on the authority of Manṣūr, who said: Ibrāhīm used to say: its food is the salted fish. Then he said afterwards: what it casts out.
* - Hannād related to us, saying: Ibn Abī Zāʾida related to us, saying: al-Thawrī informed us, on the authority of Abū Ḥaṣīn, on the authority of Saʿīd ibn Jubayr, who said: طعامه the salted (fish).
9907 - Hannād related to us, saying: Ibn Abī Zāʾida related to us, saying: Isrāʾīl informed us, on the authority of ʿAbd al-Karīm, on the authority of Mujāhid, who said: طعامه the salted fish.
9908 - Ibn Bashshār related to us, saying: Muḥammad ibn Jaʿfar related to us, saying: Shuʿba related to us, on the authority of Abū Bishr, on the authority of Saʿīd ibn Jubayr, concerning this verse: وطعامه متاعا لكم he said: al-ṣīr. Shuʿba said: I said to Abū Bishr: what is al-ṣīr? He said: the salted (fish).
* - Ibn al-Muthannā related to us, saying: Hishām ibn al-Walīd related to us, saying: Shuʿba related to us, on the authority of Abū Bishr, on the authority of Jaʿfar ibn Abī Waḥshiyya, on the authority of Saʿīd ibn Jubayr, concerning His word: وطعامه متاعا لكم he said: al-ṣīr. He said: I said: what is al-ṣīr? He said: the salted (fish).
9909 - Muḥammad ibn al-Ḥusayn related to me, saying: Aḥmad ibn al-Mufaḍḍal related to us, saying: Asbāṭ related to us, on the authority of al-Suddī: وطعامه متاعا لكم he said: as for its food, that is the salted (fish).
9910 - Al-Qāsim related to us, saying: al-Ḥusayn related to us, saying: Abū Sufyān related to us, on the authority of Maʿmar, on the authority of al-Zuhrī, on the authority of Saʿīd ibn al-Musayyab: وطعامه متاعا لكم he said: its food is what you take as salted provision on your journey.
9911 - ʿAmr ibn ʿAbd al-Ḥamīd and Saʿīd ibn al-Rabīʿ al-Rāzī related to us, both saying: Sufyān related to us, on the authority of ʿAmr, who said: Jābir ibn Zayd said: we used to say that its food is its salted (fish), and we disapproved of what floated on the surface of it.
And others said: طعامه is everything that is in it. Mention of who said that:
9912 - Ibn Wakīʿ related to us, saying: Ibn ʿUyayna related to us, on the authority of ʿAmr, on the authority of ʿIkrima, who said: the food of the sea is what is in it.
9913 - Ibn Wakīʿ related to us, saying: my father related to us, on the authority of Ḥurayth, on the authority of ʿIkrima: وطعامه متاعا لكم he said: what the sea brings forth in any manner.
9914 - Ibn Wakīʿ related to us, saying: Ḥumayd ibn ʿAbd al-Raḥmān related to us, on the authority of Ḥasan ibn Ṣāliḥ, on the authority of Layth, on the authority of Mujāhid, who said: its food is everything that is caught of it.
The correct of these opinions according to us is the opinion of him who said: its food is what the sea casts out or from which it withdraws so that it is found dead on its shore. And that is because Allah, the Exalted, mentioned before it the game that is hunted, and said: أحل لكم صيد البحر So what must connect with that in the sentence is that which is not caught of it, so that He says: Lawful for you is the game of what you have caught of the sea and what you have not caught of it. As for the salted (fish), that is what is salted after the catching, and that already falls under the generality of His word: أحل لكم صيد البحر so there is no ground for repeating it, since there would be no benefit in it. Allah, the Exalted, has already informed His servants of the lawfulness of what is caught from the sea by His word أحل لكم صيد البحر so there is no benefit in saying to them after that: "and its salted (fish) that has been caught is lawful for you," for what is caught of it, He has already clarified its lawfulness, whether fresh or salted, by His word: أحل لكم صيد البحر And Allah is exalted far above addressing His servants with something that affords them no benefit. And there is related from the Messenger of Allah ﷺ a narration in agreement with what we have said, even though some of its transmitters stop the chain at the one who narrates it from him among the Companions (ṣaḥāba). And that is what:
9915 - Hannād ibn al-Sarī related to us, saying: ʿAbda ibn Sulaymān related to us, on the authority of Muḥammad ibn ʿAmr, who said: Abū Salama related to us, on the authority of Abū Hurayra, who said: the Messenger of Allah ﷺ said: أحل لكم صيد البحر وطعامه متاعا لكم he said: "its food is what it spits out dead, that is its food." And some have stopped this narration at Abū Hurayra.
9916 - Hannād related to us, saying: Ibn Abī Zāʾida related to us, on the authority of Muḥammad ibn ʿAmr, on the authority of Abū Salama, on the authority of Abū Hurayra, concerning His word: أحل لكم صيد البحر وطعامه he said: its food is what it spits out dead.
متاعا لكم وللسيارة ("as an enjoyment for you and for the travelers")
The exposition of His exalted word: متاعا لكم وللسيارة ("as an enjoyment for you and for the travelers"). The Exalted, whose praise be mentioned, means by His word: متاعا لكم a benefit for whoever of you is residing or present in his land, who enjoys eating it and benefits from it. وللسيارة He says: and also a benefit and enjoyment for the travelers who move from one land to another, and for the wayfarers who take it as salted provision on their journey. And "al-sayyāra" is the plural of "sayyār" (traveler). In accordance with what we have said about it, the people of exposition spoke. Mention of who said that:
9917 - Yaʿqūb related to me, saying: Hushaym related to us, saying: Abū Isḥāq informed me, on the authority of ʿIkrima, that he said concerning His word: متاعا لكم وللسيارة for whoever is in the vicinity of the sea; وللسيارة the journey.
9918 - Yaʿqūb related to me, saying: Ibn ʿUlayya related to us, on the authority of Saʿīd ibn Abī ʿArūba, on the authority of Qatāda, concerning His word: وطعامه متاعا لكم وللسيارة what the sea casts out, and what they take on their journeys as provision of this salted (fish). Thus he explained it.
* - Bishr ibn Muʿādh related to us, saying: Jāmiʿ related to us on the authority of Ḥammād, saying: Yazīd ibn Zurayʿ related to us, saying: Saʿīd related to us, on the authority of Qatāda: وطعامه متاعا لكم وللسيارة the salted fish that they take on their journeys as provision.
9919 - Sulaymān ibn ʿAmr ibn Khālid al-Barqī related to us, saying: Miskīn ibn Bukayr related to us, saying: ʿAbd al-Salām ibn Ḥabīb al-Najjārī related to us, on the authority of al-Ḥasan, concerning His word: وللسيارة he said: they are the ones in the state of consecration (al-muḥrimūn).
9920 - Muḥammad ibn al-Ḥusayn related to me, saying: Aḥmad ibn al-Mufaḍḍal related to us, saying: Asbāṭ related to us, on the authority of al-Suddī: وطعامه متاعا لكم وللسيارة as for its food, that is the salted of it, as provision of which the travelers eat on the journeys.
9921 - Al-Muthannā related to us, saying: Abū Ṣāliḥ related to us, saying: Muʿāwiya ibn Ṣāliḥ related to me, on the authority of ʿAlī ibn Abī Ṭalḥa, on the authority of Ibn ʿAbbās: وطعامه متاعا لكم وللسيارة he said: its food is its salted (fish) and what the sea casts out of it and what the traveler takes as provision. And another time he said: its salted (fish) and what the sea casts out; and the salted (fish) the traveler takes as provision.
9922 - Muḥammad ibn Saʿd related to me, saying: my father related to me, saying: my uncle related to me, saying: my father related to me, on the authority of his father, on the authority of Ibn ʿAbbās: وطعامه متاعا لكم وللسيارة that is to say the salted (fish), which he takes as provision.
And Mujāhid said about it what:
9923 - Muḥammad ibn ʿUmar related to me, saying: Abū ʿĀṣim related to us, saying: ʿĪsā related to us, on the authority of Ibn Abī Najīḥ, on the authority of Mujāhid: وطعامه متاعا لكم he said: the people of the villages; وللسيارة the people of the cities.
* - Al-Qāsim related to us, saying: al-Ḥusayn related to us, saying: Ḥajjāj related to me, on the authority of Ibn Jurayj, on the authority of Mujāhid, concerning His word: متاعا لكم he said: for the people of the villages; وللسيارة he said: the people of the cities and all kinds of people.
And this that Mujāhid said — that the travelers are the people of the cities — has no intelligible ground, unless by his word "they are the people of the cities" he meant: they are the travelers among the people of the cities. Then under it must fall every traveler, whether they are of the people of the cities or of the people of the villages. As for the travelers, that does not include those residing in their cities.
وحرم عليكم صيد البر ما دمتم حرما ("and forbidden to you is the game of the land so long as you are in consecration")
The exposition of His exalted word: وحرم عليكم صيد البر ما دمتم حرما ("and forbidden to you is the game of the land so long as you are in consecration"). The Exalted, whose praise be mentioned, means: and forbidden to you, O believers, is the game of the land so long as you are in consecration (ḥaram), He says: so long as you are in the state of consecration (muḥrim) and have not come out of your consecration. Then the people of knowledge differed concerning the meaning that Allah, the Exalted, intended by His word وحرم عليكم صيد البر . Some said: by it is meant that He has forbidden us every sense of the game of the land: the hunting of it, the eating of it, the killing of it, the selling of it, the buying of it, the holding of it and the possessing of it. Mention of who said that:
9924 - Yaʿqūb related to me, saying: Hushaym related to us, on the authority of Yazīd ibn Abī Ziyād, on the authority of ʿAbdallāh ibn al-Ḥārith, on the authority of Nawfal, on the authority of his father, who said: ʿUthmān ibn ʿAffān performed the ḥajj, and ʿAlī performed the ḥajj with him. He said: meat of game that a non-consecrated person had hunted was brought to ʿUthmān, and he ate of it, but ʿAlī did not eat. ʿUthmān said: by Allah, we did not hunt, nor command it, nor point to it! ʿAlī said: وحرم عليكم صيد البر ما دمتم حرما .
9925 - Ibn Ḥumayd related to us, saying: Hārūn ibn al-Mughīra related to us, on the authority of ʿAmr ibn Abī Qays, on the authority of Simāk, on the authority of Ṣubayḥ ibn ʿUbaydallāh al-ʿAbsī, who said: ʿUthmān ibn ʿAffān sent Abū Sufyān ibn al-Ḥārith to al-ʿArūḍ, and he halted at Qudayd. A man from the people of Syria passed by him with a hawk and a falcon, and he borrowed them from him, and caught with them some of the yaʿāqīb (a kind of partridge) and put them in an enclosure. When ʿUthmān passed by him, he cooked them and set them before him, and ʿUthmān said: eat! Some said: until ʿAlī ibn Abī Ṭālib comes. When ʿAlī came and saw what was before them, ʿAlī said: we will not eat of it! ʿUthmān said: what is the matter with you that you do not eat? He said: it is game, and it is not lawful to eat it while I am in the state of consecration. ʿUthmān said: explain it to us! ʿAlī said: يا أيها الذين آمنوا لا تقتلوا الصيد وأنتم حرم ("O you who believe, do not kill game while you are in consecration"). ʿUthmān said: have we killed it then? Then he recited to him: أحل لكم صيد البحر وطعامه متاعا لكم وللسيارة وحرم عليك صيد البر ما دمتم حرما .
9926 - Tamīm ibn al-Muntaṣir and ʿAbd al-Ḥamīd ibn Bayān al-Qannād related to us, both saying: Abū Isḥāq al-Azraq informed us, on the authority of Sharīk, on the authority of Simāk ibn Ḥarb, on the authority of Ṣubayḥ ibn ʿUbaydallāh al-ʿAbsī, who said: ʿUthmān ibn ʿAffān appointed Abū Sufyān ibn al-Ḥārith over al-ʿArūḍ. Then he mentioned something similar, and he added to it: He said: ʿUthmān stayed as long as Allah willed that he stay. Then he came, and it was said to him in Mecca: do you wish to go to Ibn Abī Ṭālib? Flayed donkey meat has been offered to him and he is eating of it! ʿUthmān sent to him and asked him about eating the flayed meat, and he said: as for you, you eat; but do you forbid it to us? He said: it is game from the previous year, and I was then non-consecrated, so there is nothing wrong for me in eating it; but that game — namely the yaʿāqīb — was hunted while I am in the state of consecration, and they were slaughtered while I am in consecration.
9927 - ʿImrān ibn Mūsā al-Qazzāz related to us, saying: ʿAbd al-Wārith ibn Saʿīd related to us, saying: Yūnus related to us, on the authority of al-Ḥasan: that ʿUmar ibn al-Khaṭṭāb saw no objection to the one in the state of consecration eating the meat of game, but ʿAlī ibn Abī Ṭālib — may Allah be pleased with him — disapproved of it.
9928 - Muḥammad ibn ʿAbdallāh ibn Bazīʿ related to us, saying: Bishr ibn al-Mufaḍḍal related to us, saying: Saʿīd related to us, on the authority of Qatāda, on the authority of Saʿīd ibn al-Musayyab: that ʿAlī disapproved of the meat of game for the one in the state of consecration in any case.
9929 - Muḥammad ibn al-Muthannā related to us, saying: Muḥammad ibn Jaʿfar related to us, saying: Shuʿba related to us, on the authority of Yazīd ibn Abī Ziyād, on the authority of ʿAbdallāh ibn al-Ḥārith: that he was present with ʿUthmān and ʿAlī when meat was brought to them; ʿUthmān ate, but ʿAlī did not eat. ʿUthmān said: have we hunted, or has it been hunted for us? Then ʿAlī recited this verse: أحل لكم صيد البحر وطعامه متاعا لكم وللسيارة وحرم عليكم صيد البر ما دمتم حرما .
9930 - Yaʿqūb related to me, saying: Hushaym related to us, saying: ʿUmar ibn Abī Salama informed us, on the authority of his father, who said: ʿUthmān ibn ʿAffān performed the ḥajj, and ʿAlī performed the ḥajj with him. 9931 - Ibn Ḥumayd related to us, saying: Hārūn related to us, on the authority of ʿAmr, on the authority of ʿAbd al-Karīm, on the authority of Mujāhid, on the authority of ʿAbdallāh ibn al-Ḥārith ibn Nawfal: that a piece of the hindquarters of a donkey was brought to ʿAlī while he was in the state of consecration, and he said: I am in the state of consecration.
9932 - Ibn Bazīʿ related to us, saying: Bishr ibn al-Mufaḍḍal related to us, saying: Saʿīd related to us, on the authority of Yaʿlā ibn Ḥakīm, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās: that he disapproved of it in any case so long as one was in the state of consecration.
9933 - Ibn Bashshār related to us, saying: Abū ʿĀṣim related to us, saying: Ibn Jurayj related to us, saying: Nāfiʿ informed us that Ibn ʿUmar disapproved of everything of game so long as he was in consecration, whether it was caught for him or not caught for him, dried meat (washīqa) and otherwise.
* - Ibn al-Muthannā related to us, saying: Yaḥyā ibn Saʿīd al-Qaṭṭān related to us, on the authority of ʿAbdallāh, who said: Nāfiʿ informed me: that Ibn ʿUmar did not eat game so long as he was in the state of consecration, even if a non-consecrated person had hunted it.
9934 - Ibn Bashshār related to us, saying: Abū ʿĀṣim related to us, saying: Ibn Jurayj informed us, saying: al-Ḥasan ibn Muslim ibn Yannāq informed me: that Ṭāwūs forbade the one in consecration to eat game, dried meat (washīqa) and otherwise, whether it was hunted for him or not hunted for him.
9935 - ʿAbd al-Aʿlā related to us, saying: Khālid ibn al-Ḥārith related to us, saying: al-Ashʿath related to us, saying: al-Ḥasan said: if someone hunts game and then enters consecration, he does not eat of its meat until he comes out of consecration. And if he does eat of it while he is in the state of consecration, al-Ḥasan saw no obligation (of expiation) resting upon him for that.
9936 - Ibn Ḥumayd related to us, saying: Ḥakkām and Hārūn related to us on the authority of ʿAnbasa, on the authority of Sālim, who said: I asked Saʿīd ibn Jubayr about the game that the non-consecrated person hunts: may the one in consecration eat of it? He said: I will mention to you something about that. Allah, the Exalted, has said: يا أيها الذين آمنوا لا تقتلوا الصيد وأنتم حرم so He forbade killing it. Then He said: ومن قتله منكم متعمدا فجزاء مثل ما قتل من النعم ("and whoever of you kills it intentionally, then the recompense is the like of what he killed, in livestock"). Then the Exalted said: أحل لكم صيد البحر وطعامه متاعا لكم وللسيارة he said: the man comes to the people of the sea and says: give me to eat! If he says: "fresh," they cast their net and catch for him; and if he says: give me of your food! they give him of their salted fish. Then He said: وحرم عليكم صيد البر ما دمتم حرما and it is forbidden to you, whether you hunted it yourself or a non-consecrated person hunted it.
And others said: Allah, the Exalted, meant by His word وحرم عليكم صيد البر ما دمتم حرما only that which the one in consecration newly hunts during his consecration or slaughters, or what is newly hunted for him in that state. But what a non-consecrated person has slaughtered for a non-consecrated person, there is nothing wrong for the one in consecration in eating it; and likewise what was in his possession before the state of his consecration, the holding of it is not forbidden to him. 9937 - Muḥammad ibn ʿAbdallāh ibn Bazīʿ related to me, saying: Bishr ibn al-Mufaḍḍal related to us, saying: Saʿīd related to us, saying: Qatāda related to us, that Saʿīd ibn al-Musayyab told him, on the authority of Abū Hurayra, that he was asked about game that a non-consecrated person had hunted: may the one in consecration eat it? He said: he gave him the fatwa that he might eat it. Then he met ʿUmar ibn al-Khaṭṭāb and informed him of what had happened, and he said: had you given them a fatwa other than this, I would have struck your head a painful blow!
9938 - Aḥmad ibn ʿAbda al-Ḍabbī related to us, saying: Abū ʿAwāna related to us, on the authority of ʿUmar ibn Abī Salama, on the authority of his father, who said: ʿUthmān ibn ʿAffān halted at al-ʿArj while he was in the state of consecration, and the owner of al-ʿArj presented him with sandgrouse (qaṭā). He said: he said to his companions: eat, for it was hunted only on my name! He said: they ate, but he did not eat.
9939 - Ibn Bashshār and Ibn al-Muthannā related to us, both saying: Ibn Abī ʿAdī related to us, on the authority of Saʿīd, on the authority of Qatāda, on the authority of Saʿīd ibn al-Musayyab: that Abū Hurayra was in al-Rabadha, and they asked him about the meat of game that a non-consecrated person had hunted. Then he mentioned something similar to the narration of Ibn Bazīʿ on the authority of Bishr.

9940 - Ibn al-Muthannā related to us, saying: Ibn Abī ʿAdī related to us, on the authority of Shuʿba, on the authority of Abū Isḥāq, on the authority of Abū al-Shaʿthāʾ, who said: I asked Ibn ʿUmar about the meat of game that the non-consecrated person gives to the one in consecration, and he said: ʿUmar ate it, and he saw no objection to it. He said: I said: do you eat it? He said: ʿUmar is better than I.
* - Ibn al-Muthannā related to us, saying: Yaḥyā ibn Saʿīd related to us, on the authority of Shuʿba, who said: Abū Isḥāq related to us, on the authority of Abū al-Shaʿthāʾ, who said: I asked Ibn ʿUmar about game that a non-consecrated person had hunted, whether one in consecration may eat of it? He said: ʿUmar ate it. He said: I said: and you? He said: ʿUmar was better than I.
9941 - Ibn al-Muthannā related to us, saying: Ibn Abī ʿAdī related to us, on the authority of Hishām, on the authority of Yaḥyā, on the authority of Abū Salama, on the authority of Abū Hurayra, who said: a man from the people of Syria asked me for a fatwa about the meat of game that he had obtained while he was in the state of consecration, and I commanded him to eat it. Then I came to ʿUmar ibn al-Khaṭṭāb and said to him: a man from the people of Syria asked me for a fatwa about the meat of game that he obtained while he was in the state of consecration. He said: what fatwa did you give him? He said: I said: I gave him the fatwa that he might eat it. He said: by Him in whose hand my soul is, had I given you a different fatwa, I would have chastised you with the whip! And ʿUmar said: I only forbade you to hunt it.
9942 - Abū Kurayb related to us, saying: Muṣʿab ibn al-Miqdām related to us, saying: Khārija related to us on the authority of Zayd ibn Aslam, on the authority of ʿAṭāʾ, on the authority of Kaʿb, who said: I arrived with some people in consecration, and we obtained the meat of a wild donkey. The people asked me about eating it, and I gave them the fatwa to eat it while they were in the state of consecration. Then we came to ʿUmar, and they informed him that I had given them the fatwa to eat the meat of the wild donkey while they were in the state of consecration. ʿUmar said: I have appointed him over you until you return.
9943 - Yaʿqūb related to me, saying: Hushaym related to us, saying: Yaḥyā ibn Saʿīd informed us, on the authority of Saʿīd ibn al-Musayyab, on the authority of Abū Hurayra, who said: I passed by al-Rabadha, and its inhabitants asked me about the one in consecration who eats what a non-consecrated person has hunted, and I gave them the fatwa to eat it. Then I met ʿUmar ibn al-Khaṭṭāb and mentioned that to him. He said: what fatwa did you give them? He said: I gave them the fatwa to eat it. He said: had you given them a different fatwa, I would have contradicted you.
9944 - Ibn Ḥumayd related to us, saying: Yaḥyā ibn Wāḍiḥ related to us, on the authority of Yūnus, on the authority of Abū al-Shaʿthāʾ al-Kindī, who said: I said to Ibn ʿUmar: how do you judge concerning people in the state of consecration who meet non-consecrated people who have with them the meat of game, whether they sold it to them or gave them to eat? He said: lawful.
9945 - Saʿīd ibn Yaḥyā al-Umawī related to us, saying: Muḥammad ibn Saʿīd related to us, saying: Hishām — that is, Ibn ʿUrwa — related to us, saying: ʿUrwa related to us, on the authority of Yaḥyā ibn ʿAbd al-Raḥmān ibn Ḥāṭib, that ʿAbd al-Raḥmān told him: that he performed the ʿumra with ʿUthmān ibn ʿAffān in a travel company in which was ʿAmr ibn al-ʿĀṣ, until they halted at al-Rawḥāʾ. Bird (meat) was set before them while they were in the state of consecration, and ʿUthmān said to them: eat, for I will not eat of it! ʿAmr ibn al-ʿĀṣ said: do you command us something that you yourself do not eat? ʿUthmān said: if I did not suspect that it was hunted for my sake, I would eat of it. Then the people ate.
9946 - Ibn al-Muthannā related to us, saying: Muḥammad ibn Jaʿfar related to us, saying: Shuʿba related to us, on the authority of Hishām ibn ʿUrwa, on the authority of his father: that al-Zubayr took the meat of game as provision while he was in the state of consecration.
9947 - ʿAbd al-Ḥamīd ibn Bayān related to us, saying: Isḥāq informed us, on the authority of Sharīk, on the authority of Simāk ibn Ḥarb, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, who said: what is hunted or slaughtered while you are non-consecrated, that is lawful for you; and what is hunted or slaughtered while you are in the state of consecration, that is forbidden for you.
* - Ibn Ḥumayd related to us, saying: Hārūn related to us, on the authority of ʿAmr, on the authority of Simāk, on the authority of ʿIkrima, on the authority of Ibn ʿAbbās, who said: whatever is hunted of anything while you are in the state of consecration, that is forbidden for you; and what is hunted while you are non-consecrated, that is lawful for you.
9948 - Muḥammad ibn Saʿd related to me, saying: my father related to me, saying: my uncle related to me, saying: my father related to me, on the authority of his father, on the authority of Ibn ʿAbbās: وحرم عليكم صيد البر ما دمتم حرما Thus He made game forbidden for the one in consecration: the hunting of it and the eating of it, so long as he is in the state of consecration. And if the game was hunted before the man entered consecration, then it is lawful. And if one in consecration hunts it for a non-consecrated person, then it is not lawful for him to eat it.
9949 - Yaʿqūb related to me, saying: Hushaym related to us, saying: I asked Abū Bishr about the one in consecration who eats of what the non-consecrated person has hunted. He said: Saʿīd ibn Jubayr and Mujāhid used to say: what is hunted before he entered consecration, of that he eats; and what is hunted after he entered consecration, of that he does not eat.
9950 - Ibn Bashshār related to us, saying: Abū ʿĀṣim related to us, saying: Ibn Jurayj related to us, saying: ʿAṭāʾ used to say, when he was asked in public whether the one in consecration might eat dried meat (al-washīqa) and the dry: he said between him and me: I cannot expound it to you in a single sitting; if it was slaughtered before he entered consecration, eat of it, and if not, then do not sell its meat and do not buy it.
And others said: Allah, the Exalted, meant by His word وحرم عليكم صيد البر ما دمتم حرما only: and forbidden to you is the hunting of it. They said: but as for buying it from an owner who possesses it, and slaughtering and eating it after he has come to possess it by a means other than hunting it, and selling and buying it — that is lawful. They said: and the prohibition of Allah, the Exalted, concerns only the hunting of it in the state of consecration, to the exclusion of the remaining senses. Mention of who said that:
9951 - ʿAbdallāh ibn Aḥmad ibn Shabbawayh related to me, saying: Ibn Abī Maryam related to us, saying: Yaḥyā ibn Ayyūb related to us, saying: Yaḥyā informed me, that Abū Salama bought sandgrouse (qaṭā) while he was in al-ʿArj and in the state of consecration, and Muḥammad ibn al-Munkadir was with him, and he ate them. The people made that a reproach against him.
And the correct view about it according to us is that one says: Allah, the Exalted, made general the prohibition of every sense of the game of the land for the one in consecration in his state of consecration, without singling out any of it above any other. So every sense of hunting is forbidden for the one in consecration so long as he is in the state of consecration: the selling of it, the buying of it, the hunting of it, the killing of it and the rest of its senses — unless he finds it slaughtered, slaughtered by a non-consecrated person for a non-consecrated person, then it is lawful for him at that point to eat it, on account of the narration that is established as sound from the Messenger of Allah ﷺ, namely:
9952 - Yaʿqūb ibn Ibrāhīm related this to us, saying: Yaḥyā ibn Saʿīd related to us, on the authority of Ibn Jurayj. And ʿAbdallāh ibn Abī Ziyād related to me, saying: Makkī ibn Ibrāhīm related to us, saying: ʿAbd al-Malik ibn Jurayj related to us, saying: Muḥammad ibn al-Munkadir informed me, on the authority of Muʿādh ibn ʿAbd al-Raḥmān ibn ʿUthmān, on the authority of his father ʿAbd al-Raḥmān ibn ʿUthmān, who said: we were with Ṭalḥa ibn ʿUbaydallāh while we were in the state of consecration, and a bird was presented to us. Some of us ate and some of us refrained out of piety and did not eat. When Ṭalḥa awoke, he gave his approval to whoever ate and said: we ate it together with the Messenger of Allah ﷺ.
And if someone says: what then do you say about what is related on the authority of al-Ṣaʿb ibn Jaththāma: that a man presented the Messenger of Allah ﷺ with a wild donkey that was dripping blood, and he returned it and said: "we are in the state of consecration (ḥaram)"? And about what is related on the authority of ʿĀʾisha: "that dried gazelle meat was presented to the Messenger of Allah ﷺ while he was in the state of consecration, and he returned it," and what resembles that of narrations? — Then it is said: in none of these narrations that have come with this purport is there a clarification that the Messenger of Allah ﷺ returned what he returned while the slaughterer had already slaughtered it when he slaughtered it, and it was lawful as a non-consecrated person for a non-consecrated person, and he then presented it to the Messenger of Allah ﷺ while he was in the state of consecration, whereupon he returned it and said: it is not lawful for us because we are in the state of consecration. It is only mentioned that the Messenger of Allah ﷺ was presented with the meat of game and he returned it; and it is possible that he returned that because its slaughterer slaughtered it or its hunter caught it for his sake ﷺ while he was in the state of consecration. And the narration of Jābir on the authority of the Prophet ﷺ has clarified the meaning of all of this, with his word: "The meat of the game of the land is lawful for the one in consecration, except that which he has hunted or what has been hunted for him." If both narrations are sound in their origin, then it is obligatory to hold both as true and to apply each of them to the correct case in a particular manner, and to say: he returned that which he returned because it was hunted for his sake, and his permission for everything for which he gave permission to eat of it was because it was not hunted for one in consecration and no one in consecration had hunted it — so that the meaning of both narrations is shown to be correct.
And they differed concerning the description of the game that Allah, the Exalted, intended by the prohibition in His word: وحرم عليك صيد البر ما دمتم حرما . Some said: the game of the land is everything that lives both on the land and in the sea; and the game of the sea is only what lives in the water, without the land, and withdraws thereto. Mention of who said that:
9953 - Hannād ibn al-Sarī related to us, saying: Wakīʿ related to us — and Ibn Wakīʿ related to us, saying: my father related to us — on the authority of ʿImrān ibn Ḥudayr, on the authority of Abū Mijlaz: وحرم عليكم صيد البر ما دمتم حرما he said: what lives both on the land and in the sea, that he does not hunt; and what has its life in the water, that is that (lawful).
9954 - Yaʿqūb ibn Ibrāhīm related to me, saying: Hushaym related to us, saying: al-Ḥajjāj informed us, on the authority of ʿAṭāʾ, who said: what lives on the land and the one in consecration obtains it, upon him rests the recompense for it, such as the turtle, the crab and the frogs.
* - Ibn Ḥumayd related to us, saying: Hārūn ibn al-Mughīra related to us, on the authority of ʿAmr ibn Abī Qays, on the authority of al-Ḥajjāj, on the authority of ʿAṭāʾ, who said: everything that lives both on the land and in the sea, if the one in consecration obtains it, upon him rests the expiation (kaffāra).
9955 - Abū Kurayb and Abū al-Sāʾib related to us, both saying: Ibn Idrīs related to us, saying: Yazīd ibn Abī Ziyād related to us, on the authority of ʿAbd al-Malik, on the authority of Saʿīd ibn Jubayr, who said: we set out as pilgrims, and with us was a man from the people of al-Sawād who had with him young waterfowl, and my father said to him when we entered consecration: keep this away from us!
9956 - And Abū Kurayb related this to us another time, saying: Ibn Idrīs related to us, saying: I heard Yazīd ibn Abī Ziyād say: Ḥajjāj related to us, on the authority of ʿAṭāʾ: that he disapproved for the one in consecration of slaughtering the Zanzibar hen, because it has an origin on the land.
And some said: the game of the land is what dwells more on the land than in the sea. Mention of who said that:
9957 - Muḥammad ibn Bashshār related to us, saying: Abū ʿĀṣim related to us, Ibn Jurayj said: he informed us, saying: I asked ʿAṭāʾ about the waterbird (ibn al-māʾ): is it game of the land or of the sea? And about what resembles that. He said: where it is found most, that is its game(-category).
9958 - Al-Qāsim related to us, saying: al-Ḥusayn related to us, saying: Wakīʿ related to me, on the authority of Sufyān, on the authority of a man, on the authority of ʿAṭāʾ ibn Abī Rabāḥ, who said: where it is found most is where it breeds, that is to what it belongs.
واتقوا الله الذي إليه تحشرون ("and fear Allah, to whom you will be gathered")
The exposition of His exalted word: واتقوا الله الذي إليه تحشرون ("and fear Allah, to whom you will be gathered"). And this is an advance warning from Allah, the Exalted, whose praise be mentioned, to His creatures to beware of His punishment for their disobediences. The Exalted says: and fear Allah, O people, and guard yourselves against Him by obeying Him in what He has imposed upon you of duties and in what He has forbidden you in these verses that He has sent down to your prophet ﷺ: the prohibition of wine, gambling, the sacrificial stones and the (lot-casting) arrows, and of obtaining and killing the game of the land in the state of your consecration, and in other matters; for with Allah is your destination and your return, so that He will punish you for your disobedience to Him, and will recompense and reward you for your obedience to Him.
