إِنَّمَا حَرَّمَ عَلَيْكُمُ ٱلْمَيْتَةَ وَٱلدَّمَ وَلَحْمَ ٱلْخِنزِيرِ وَمَآ أُهِلَّ لِغَيْرِ ٱللَّهِ بِهِۦ ۖ فَمَنِ ٱضْطُرَّ غَيْرَ بَاغٍۢ وَلَا عَادٍۢ فَإِنَّ ٱللَّهَ غَفُورٌۭ رَّحِيمٌۭ

He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah. But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit] - then indeed, Allah is Forgiving and Merciful.

    Allah, the Exalted, refutes the polytheists who declared forbidden the things we mentioned — the al-baḥāʾir and the like — and says: Allah has forbidden for you, O people, nothing except carrion, blood, the flesh of swine, and that which was slaughtered for the idols while a name other than Allah's was pronounced over it, for this belongs to the slaughtered animals of one whose slaughtered animals are lawful to eat. But whoever is compelled to all of this, or to a part of it, because of a famine that has set in, and he eats of it, غَيْرَ بَاغٍ وَلَا عَادٍ (without craving it and without transgressing the limit) — فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ — Allah says: He Who covers it by not calling him to account for eating it in case of necessity, merciful toward him by not punishing him for it.

    We have already set forth previously the difference of opinion concerning His word غَيْرَ بَاغٍ وَلَا عَادٍ and the correct position regarding it, together with the proofs, so that repetition here is superfluous.

    Bishr related to us, saying: Yazīd related to us, saying: Saʿīd related to us, on the authority of Qatāda concerning His word إِنَّمَا حَرَّمَ عَلَيْكُمُ الْمَيْتَةَ وَالدَّمَ … the verse: he said: Islam is a religion which Allah purifies of all evil, and in it He has given you, O child of man, latitude when you are compelled to something of all that. His word فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلَا عَادٍ : without craving it in his eating and without transgressing the limit by passing over from the lawful to the forbidden while he can do without it.

    يقول تعالى ذكره مكذّبًا المشركين الذين كانوا يحرّمون ما ذكرنا من البحائر وغير ذلك: ما حرّم الله عليكم أيها الناس إلا الميتة والدم ولحم الخنـزير ، وما ذبح للأنصاب ، فسمي عليه غير الله ، لأن ذلك من ذبائح من لا يحلّ أكل ذبيحته، فمن اضطرّ إلى ذلك أو إلى شيء منه لمجاعة حلَّت فأكله ( غَيْرَ بَاغٍ وَلا عَادٍ فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ ) يقول: ذو ستر عليه أن يؤاخذه بأكله ذلك في حال الضرورة، رحيم به أن يعاقبه عليه. وقد بيَّنا اختلاف المختلفين في قوله ( غَيْرَ بَاغٍ وَلا عَادٍ ) والصواب عندنا من القول في ذلك بشواهده فيما مضى بما أغنى عن إعادته. حدثنا بشر، قال: ثنا يزيد، قال: ثنا سعيد، عن قتادة، قوله ( إِنَّمَا حَرَّمَ عَلَيْكُمُ الْمَيْتَةَ وَالدَّمَ ) ... الآية قال: وإن الإسلام دين يطهره الله من كلّ سوء، وجعل لك فيه يا ابن آدم سعة إذا اضطرت إلى شيء من ذلك. قوله ( فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ ) غير باغ في أكله ولا عاد أن يتعدّى حلالا إلى حرام، وهو يجد عنه مندوحة.
